We can assist with the recovery of Service Charges and Ground Rents to Manging agents, Landlords and Freeholders. Given our knowledge and experience we have a full understanding of the benefits and pitfall of taking certain steps and endeavour to provide practical advice at all times.
We usually offer this service on a Fixed Fee basis (save for exceptional circumstances that involve unusually complex or time consuming cases – in this event, we endeavour to give as much notice as possible and provide an estimate of costs). Providing the Lease allows it, we will endeavour to seek recovery of legal costs from the defaulting party or from the Lender/Mortgagor. In respect of Service Charge and Ground Rent Recovery work (save for exceptional circumstances) the procedure and our charges are set out below:
Sending Letters Before Action to Leaseholders – £15.00 + VAT per letter
Issuing Proceedings and obtaining Judgment – £300 + VAT plus Court Fees
Writing to Lender/Mortgagor – £50.00 + VAT
Drafting and Serving Section 146 Notices pursuant to the Housing Act 1988 – £200.00 + VAT
