Prior to Brexit, we were one of the very few law firms who used the European Order for Payment process and European Enforcement Orders to pursue debtors based within the European Union. Since Brexit, the procedure of pursuing debtors within the European Union is now processed differently, however, we still remain able to pursue debtors within the EU and beyond. We have built up a network of international contacts and agents who continue to assist us in processing and enforcing such claims.
Different countries will have different requirements. What action and procedure applies will depend on the country your debtor is based in, and so our advice will be tailored on a case by case basis. Some countries may automatically recognise Judgment Orders obtained in England and Wales to enable you to proceed with enforcement action against your debtor with relative ease, but some will not. We will endeavour to guide you every step of the way, whatever the requirements may be, and may refer you to agents based in your debtor’s home country as and when required. Please note that this is an area that is rapidly evolving following Brexit.
